Background & Summary

In 1990, EPA promulgated Phase I of its storm water program under the National Pollutant Discharge Elimination System (NPDES) permit provisions of the Clean Water Act. Phase I addressed storm water runoff from “medium” and “large” municipal separate storm sewer systems (MS4s) generally serving populations of 100,000 or greater, construction activity that would disturb five or more acres of land, and 10 categories of industrial activity. To further reduce the adverse effects of storm water runoff, EPA instituted its Storm Water Phase II Final Rule on December 8, 1999.

Phase II regulates discharges from small MS4s located in “urbanized areas” (as delineated by the Census Bureau in the most recent census) and from additional small MS4s designated by the permitting authority. Phase II also regulates construction activities that would disturb greater than one (1) acres of land.

MS4s are typically operated by municipalities, and is not always just a system of underground pipes; it can include roads with drainage systems, gutters, and ditches and detention ponds.

The EPA determined there are six Minimum Control Measures, which need to be addressed for the Phase II National Pollutant Discharge Elimination System (NPDES) program. These measures will be addressed by implementing Best Management Practices (BMPs) appropriate for Uxbridge’s community. The BMPs will commence according to schedules approved by EPA.  The Stormwater Management Plan (SWMP)  includes Six Minimum Control Measures for storm water quality enhancement.  Implementation of the SWMP is primarily the responsibility of the DPW.

Back in 2004 the Committee was formed and the charge with the duties to ensure compliance with the Phase II program. During the summer of 2011, the Stormwater Committee was rejuvenated with the primary objective to develop the required by-laws needed for stormwater management, erosion and sedimentation control and illicit discharge and elimination.  The Committee presented a proposed by-law at the 2012 Spring Annual Town Meeting.  Passage of the by-law was not obtained by a 2/3rds majority.  The Committee is beginning to address the concerns of the public and will be holding periodic committee meetings in order to update the current draft by-law.  We anticipate engaging the public, as well as, other Town Departments in the development of the by-law.  We intend to have another version ready for the 2013 Annual Town Meeting.
